1. Acceptance of Terms
By using this website, requesting a quote, or entering into a service agreement with MIRJ Production, you agree to be bound by these Terms and Conditions. If you do not accept these terms, please do not use this website or our services.
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and the Protection of Personal Information Act 4 of 2013 (POPIA).
2. Services
MIRJ Production provides digital creative services including but not limited to: videography, photography, content management, web design, search engine optimisation, AI automation, and business optimisation packages. Specific deliverables, timelines and pricing will be confirmed in writing via a formal quotation before work commences.
2.1 Capacity Clause — Premium Packages
For the Exclusive Content Package (R5,000/mo), Full House (R6,800/mo), Full House Premium (R8,024/mo) and all other Business Optimisation packages, all production — including photoshoots, reels, video adverts, ad campaigns and full content management — is scheduled across the contracted month and subject to booking capacity. Specific shoot dates, delivery timelines and content volumes will be confirmed at the start of each monthly cycle. Rush requests outside the agreed schedule may incur additional fees.
3. Quotations & Pricing
- All prices quoted are in South African Rand (ZAR) and are exclusive of VAT unless stated otherwise.
- Quotations are valid for 30 days from the date of issue.
- Prices on this website are indicative and subject to a formal written quotation confirming specific deliverables.
- Annual plan pricing reflects a 7% discount on the stated monthly rate, calculated over 12 months and invoiced upfront.
- MIRJ Production reserves the right to adjust pricing with 30 days' written notice to existing retainer clients.
4. Payment Terms

Late payments may attract interest at the prime lending rate plus 2% per month. MIRJ Production reserves the right to pause services on accounts overdue by more than 14 days.
5. Cancellation Policy
5.1 Once-off projects
The 50% deposit is non-refundable if the client cancels after project brief sign-off, as work will have commenced. Cancellations prior to brief sign-off will receive a full deposit refund.
5.2 Monthly retainers
A minimum 3-month initial commitment applies to all monthly service plans. After the initial period, either party may cancel with 30 days' written notice. No partial-month refunds are issued.
5.3 Photoshoots & events
Cancellations within 72 hours of a confirmed shoot date will forfeit the 50% deposit. Reschedules within 72 hours are subject to a R500 rescheduling fee.
5.4 Annual plans
Annual plan payments are non-refundable after 14 days of payment. In the event of cancellation after 14 days, remaining months will be applied as a service credit.
6. Intellectual Property & Copyright
6.1 Commissioned photography & video
Upon receipt of full payment, the client receives a non-exclusive, commercial licence to use all delivered photographs and video content for their business purposes. MIRJ Production retains the right to use delivered content in its portfolio, website, social media and marketing materials, unless the client requests in writing that specific content be kept confidential prior to project commencement.
6.2 Website & digital assets
Website designs, code and digital deliverables created by MIRJ Production remain the intellectual property of MIRJ Production until full payment is received, at which point ownership transfers to the client (excluding third-party components licensed separately).
6.3 Pre-existing materials
Clients warrant that any materials (logos, images, copy) supplied to MIRJ Production for use in their project are owned by or properly licensed to the client. MIRJ Production accepts no liability for third-party intellectual property claims arising from client-supplied materials.
7. Model Releases & Personality Rights
Where photography or videography involves identifiable persons (other than the client), MIRJ Production will obtain written model release consent before using such content in any marketing, portfolio or promotional material. Clients commissioning shoots involving their own employees or customers are responsible for ensuring appropriate consents are in place.
8. Liability Limitation
MIRJ Production's aggregate liability to any client arising from any service engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim in the preceding 3 months. MIRJ Production is not liable for any indirect, consequential, special or incidental loss or damage.
MIRJ Production does not guarantee specific outcomes from SEO, social media management or advertising campaigns, as results depend on factors outside our direct control including platform algorithms and market conditions.
9. Delivery Timelines
- Websites: 5–10 business days from signed brief and receipt of deposit
- Edited photography: 5–7 business days from shoot date
- Video edits: 7–14 business days from shoot date
- Monthly content: Posted according to agreed content calendar
- AI bots: 5–10 business days from signed brief
Timelines are indicative and may vary based on project complexity, revision rounds and client responsiveness in supplying required materials.
10. Revisions
All projects include 2 rounds of revisions. Additional revision rounds beyond this are quoted separately and must be approved in writing before work proceeds. Revisions must be submitted as consolidated feedback per round.
11. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the engagement. MIRJ Production will not disclose client business information, strategies or pricing to any third party without consent, except where required by law.
12. Website Use
This website and its content are provided for informational purposes. While we endeavour to keep information accurate and current, MIRJ Production makes no representations or warranties as to the completeness or accuracy of the information on this website. Use of this website is at your own risk.
13. Changes to These Terms
MIRJ Production may update these Terms and Conditions at any time. The updated version will be published on this website with a revised "Last updated" date. Continued use of our services after any update constitutes acceptance of the revised terms.
14. Disputes
In the event of any dispute arising from these terms or any service agreement, the parties will first attempt to resolve the matter amicably. If unresolved within 21 days, disputes will be referred to mediation in Cape Town, South Africa, under South African law.
